Digital service act
Information published by Eventim sp. z o.o. in connection with Regulation (EU) 2022/2065 of the European Parliament and of the Council of 19 October 2022 on a Single Market For Digital Services and amending Directive 2000/31/EC (hereinafter the "Digital Services Act"):
I. Single point of contact for Member State authorities, the Commission and the Board for Digital Services (arts. 11 and 61 of the Digital Services Act): dsa.organy@eventim.pl. Communication may be conducted in Polish and English.
This contact point is not intended for communication with recipients of the service or for submitting notices referred to in Article 16 of the Digital Services Act.
II. Point of contact for recipients of the service (Article 12 of the Digital Services Act): dsa.odbiorcy@eventim.pl
The service recipient may choose a means of communication that does not rely solely on automated tools. Communication may be conducted in Polish and English.
This contact point is not intended for submitting notifications regarding illegal content pursuant to Article 16 of the Digital Services Act - notifications must be submitted in the manner described in Section III.
III. Reporting information considered by the user to be illegal content in accordance with Article 16 of the Digital Services Act—i.e., information which, in itself or in relation to an activity (including the sale of products or the provision of services), is not in compliance with Union law or with the law of any Member State that complies with Union law.
Notifications can be made to the address: dsa.zgloszenie@eventim.pl following the available instructions HERE.
Reports may also be submitted to the aforementioned address by trusted flaggers operating in designated areas of expertise and holding trusted flagger status granted by the Digital Services Coordinator in Poland. Reports from trusted flaggers are treated as a priority.
IV. Eventim reserves the right to moderate content within the meaning of the Digital Services Act - that is, the ability to take measures aimed, in particular, at detecting, identifying, and combating illegal content or information non-compliant with the terms of service provided by recipients of the service, including the ability to implement measures affecting the availability, visibility, and accessibility of such illegal content or information (such as deprioritizing, demonetizing, blocking access to, or removing such content or information) or affecting the ability of recipients of the service to transmit such information (such as closing or suspending a recipient's account).
V. Internal complaint-handling system (Article 20 of the Digital Services Act). A recipient of the service, including a person or entity that submitted a notice in accordance with point III, may — within a period of 6 (six) months from the date of receiving information about the decision made by Eventim—submit a complaint free of charge to the address: dsa.skargi@eventim.pl. A complaint against a decision taken following the receipt of a report, or against a decision taken on the grounds that information provided by a service recipient constitutes illegal content or is incompatible with the provider’s terms of service — that is, against a decision:
- regarding the removal of information, the prevention of access to it, or the restriction of its visibility;
- regarding the suspension or termination of the provision of the service, in whole or in part, to a given recipient,
- regarding the suspension or closure of the service recipient's account,
- suspension, termination, or otherwise limiting the possibility of monetizing information provided by the service recipient.
VI. A service recipient affected by a decision made by Eventim following the receipt of a report or complaint has the right to choose any certified out-of-court dispute settlement body to resolve a dispute concerning that decision, including regarding complaints that were not resolved under the internal complaint-handling system referred to in Section V above. Recourse to out-of-court dispute settlement does not preclude the service recipient’s right to initiate proceedings before a competent court.
VII. Eventim may suspend, for a reasonable period and following prior warning, the provision of services to recipients who frequently submit content that is manifestly illegal, as well as the processing of notices and complaints submitted by individuals or entities that frequently submit manifestly unfounded notices or complaints. When deciding on a suspension, Eventim assesses on a case-by-case basis whether a given notice, complaint, or submitted content is manifestly unfounded or manifestly illegal, taking into account all relevant circumstances.
VIII. Information regarding the organizers of events for which tickets can be purchased on the Eventim website is provided in the details for each specific event.
IX. Eventim informs that the average monthly number of active users of the www.eventim.pl website was less than 45 million.
X. In accordance with Articles 15 and 24 of the Digital Services Act, Eventim publishes a transparency report at least once a year regarding content moderation activities carried out during the relevant reporting period, in a machine-readable format. The transparency report is available HERE.
